On September 9, 2011, Chicago Federal Defense Attorney Michael J. Petro filed an opening brief on behalf of his client Terrell Rogers in the Seventh Circuit Court of Appeals. USA v. Terrell Rogers, 11-1977. In the brief, he argued that the district court had erred in calculating Mr. Roger's sentence above the maximum allowed by law.
On October 11, 2011, the government in their brief agreed with Mr. Petro's legal analysis and confessed error. The government further requested that the Seventh Circuit vacate the sentence and remand his case to the district court for re-sentencing.
